1. Introduction

Welcome to NutriTrack! These Terms of Use ("Terms") govern your access to and use of the NutriTrack mobile application ("App"), including any content, functionality, and services offered through the App. By downloading, accessing, or using NutriTrack, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our App.

2. Acceptance of Terms

By creating an account or using NutriTrack, you acknowledge that you have read, understood, and agree to be bound by these Terms, as well as our Privacy Policy. You represent that you are at least 13 years of age, or the minimum age required in your jurisdiction to use the App.

3. App Usage and License

3.1 License Grant

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use NutriTrack on your mobile device for your personal, non-commercial use.

3.2 Restrictions

You agree NOT to:

• Copy, modify, or create derivative works of the App
• Reverse engineer, decompile, or disassemble the App
• Rent, lease, loan, sell, sublicense, or distribute the App
• Use the App for any illegal or unauthorized purpose
• Remove, alter, or obscure any proprietary notices from the App
• Use the App in any way that could damage, disable, or impair the service
• Attempt to gain unauthorized access to any part of the App or its systems

4. Subscription Terms

4.1 Free and Premium Plans

NutriTrack offers both free and premium subscription plans. The free version provides basic features, while the premium subscription unlocks additional features including:

• Ad-free experience
• Unlimited AI food scans
• AI-powered meal recommendations
• Custom meal plans
• Priority support
• Export data to CSV
• Unlimited meal history

4.2 Subscription Billing

Premium subscriptions are available on a monthly or yearly basis. Payment will be charged to your Apple App Store or Google Play Store account at confirmation of purchase. Subscriptions automatically renew unless auto-renewal is turned off at least 24 hours before the end of the current period.

4.3 Cancellation and Refunds

You may cancel your subscription at any time through your App Store or Google Play Store account settings. Cancellation takes effect at the end of the current billing period. Refunds are handled according to the policies of the respective app stores (Apple App Store or Google Play Store).

4.4 Price Changes

We reserve the right to modify subscription prices at any time. Price changes will not affect existing subscriptions until the next renewal period. We will notify you of any price changes in advance.

5. User Accounts and Responsibilities

5.1 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to:

• Provide accurate and complete information when creating your account
• Keep your login credentials secure and confidential
• Notify us immediately of any unauthorized access to your account
• Be responsible for all activities that occur under your account

5.2 User Content

You retain ownership of all content you create, upload, or store in NutriTrack, including meal logs, photos, and personal data. By using the App, you grant us a limited license to use this content solely for the purpose of providing and improving our services.

6. Data and Privacy

Your privacy is important to us. Our collection and use of personal information is described in our Privacy Policy. By using NutriTrack, you consent to our collection and use of personal data in accordance with our Privacy Policy.

You agree not to use NutriTrack to:

• Violate any applicable laws or regulations
• Infringe upon the rights of others, including intellectual property rights
• Transmit any harmful code, viruses, or malicious software
• Harass, abuse, or harm other users
• Impersonate any person or entity
• Interfere with or disrupt the App or its servers
• Collect or harvest information about other users
• Use automated systems or bots to access the App

8. AI Features and Accuracy

8.1 AI-Powered Scanning

NutriTrack uses AI technology powered by Google's Gemini to scan and analyze food items. While we strive for accuracy, the AI-generated nutritional information may not always be 100% accurate. You should verify important nutritional information independently, especially if you have specific dietary requirements or health conditions.

8.2 Meal Recommendations

AI-powered meal recommendations are generated based on your profile, preferences, and nutritional data. These recommendations are suggestions only and should not replace professional dietary advice.

9. Intellectual Property Rights

All content, features, and functionality of NutriTrack, including but not limited to text, graphics, logos, icons, images, audio clips, and software, are the exclusive property of NutriTrack or its licensors and are protected by international copyright, trademark, and other intellectual property laws.

10. Third-Party Services

NutriTrack integrates with various third-party services, including:

• Google Gemini AI for food scanning and analysis
• Firebase for authentication and data storage
• Apple Sign In and authentication services
• App Store and Google Play Store for subscriptions
• Google AdMob for advertisements (free version)

Your use of these third-party services is subject to their respective terms and conditions and privacy policies.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

• NutriTrack and its affiliates, officers, directors, employees, and agents SHALL NOT BE LIABLE for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, or goodwill, arising out of or related to your use of the App.
• We DO NOT WARRANT that the App will be uninterrupted, error-free, secure, or free from viruses or other harmful components.
• The nutritional information and recommendations provided by the App are for informational purposes only and should not be relied upon as a substitute for professional medical or dietary advice.
• We ARE NOT RESPONSIBLE for any health issues, adverse effects, or outcomes resulting from your use of the App or reliance on its information.

12. Indemnification

You agree to indemnify, defend, and hold harmless NutriTrack and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or related to:

• Your use of the App
• Your violation of these Terms
• Your violation of any rights of another party
• Your content or data uploaded to the App

13. Changes to Terms

We reserve the right to modify or update these Terms at any time. When we make changes, we will:

• Update the "Last Updated" date at the top of this page
• Notify you through the App or via email (if provided)
• Require your acceptance of the new Terms before continued use

Your continued use of NutriTrack after changes are made constitutes your acceptance of the revised Terms. If you do not agree to the new Terms, you must stop using the App and may cancel your subscription.

14. Termination

14.1 Termination by You

You may stop using the App and delete your account at any time through the App settings. Upon deletion, your personal data will be removed in accordance with our Privacy Policy.

14.2 Termination by Us

We reserve the right to suspend or terminate your access to NutriTrack at any time, with or without notice, for any reason, including but not limited to:

• Violation of these Terms
• Fraudulent or illegal activity
• Abuse of the service or other users
• Non-payment of subscription fees

15. Dispute Resolution and Governing Law

15.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of [Your Jurisdiction], without regard to its conflict of law provisions.

16.5 No Agency

No agency, partnership, joint venture, or employment relationship is created as a result of these Terms, and neither party has any authority to bind the other in any respect.
